Pros and Cons of Hiring a Car Accident Lawyer

The pros and cons of hiring a car accident lawyer vary depending on whether you want a free consultation or a contingency fee basis. The Insurance Research Council reports that people who hire an attorney receive a higher settlement than those who represent themselves. Hiring an attorney also allows you to refuse an insurance company’s settlement offer. Here are some of the main reasons to hire a lawyer: a free consultation, a contingency fee basis, and negotiation with parties who are legally liable.

Free consultations

When you are involved in a car accident, it is very important to contact a personal injury attorney as soon as possible. Your attorney can deal with the day-to-day issues that arise with the insurance company, as well as start an investigation to secure evidence.

During a free consultation, your attorney will gather the evidence that you need to make a compelling case for your case. Ideally, you will bring the accident police report, your insurance policy, and any correspondence you have had with the insurance company. Your attorney may also want to view a scan of these documents to better assess your case. Remember that a free consultation is only as good as the information you provide.

It is also helpful to gather any physical evidence that may be present at the scene of the accident. Obtaining any witness statements is also essential. If possible, you should also gather the contact information for the insurance carrier of the other driver. The more details you can provide, the better. Also, keep in mind the statute of limitations. In Texas, for example, the general statute of limitations is two years from the date of the accident. Other limiting factors will vary depending on the type of claim you are filing.

Contingency fee basis

Typically, attorneys work on a contingency fee basis, which means that they only get paid if they win a case. Some attorneys work on a flat fee, while others will accept a percentage of the settlement. You should discuss the fee arrangement with your attorney before hiring one. Most car accident lawyers operate on a contingency fee basis, which means that you will not be required to pay them upfront if you’re not successful in your case.

A contingency-fee attorney won’t charge you a single penny upfront, which means you can access qualified legal representation, regardless of your financial situation. This means that you can afford a lawyer even if you’re on a tight budget. Likewise, you can choose to pay the attorney only if you win your case, so you won’t be stuck paying the costs out of pocket.

A contingency-fee arrangement benefits both the plaintiff and the defendant. Those who don’t have the financial resources to hire an attorney will be able to afford the legal services they need, and a contingency-fee car accident lawyer will help them by eliminating upfront costs. After all, many accident victims can’t afford to pay upfront. This is because they’re also responsible for paying for medical bills and other non-legal fees.

Negotiation with parties with legal liability

Your car accident lawyer will help you deal with negotiations with parties with legal liability. You will need to establish who was at fault, how much damage you sustained, and what bills you will need to pay. These negotiations can take a long time, so it’s important to have a lawyer on your side. Here are some tips to make it easier. Hire a car accident lawyer to help you deal with the insurance company.

First, send a demand letter to the liable party. This letter should state the value of your claim, explain why you need the money and why the other party was at fault. Make sure to include evidence. You may not be able to get the full amount you deserve without evidence. Hiring a car accident lawyer can make the process go more smoothly and efficiently. The insurance company representative will want to investigate your claim. Then, the insurance company will offer you a counteroffer, usually a lower amount than you originally requested.

Getting a settlement can be difficult if the accident involved more than one party. Insurance companies will want to pay as little as possible, so it’s vital that you hire a lawyer who will fight for your rights and fight for a fair amount. However, the process can take months or even years, and you may not get the amount you deserve if you settle for less.

The Presumption of Guilt When Regulators Send Out Press Releases

The Presumption of Guilt When Regulators Send Out Press Releases

There is a saying in Washington, “you are innocent until you are investigated,” which basically means there is an automatic presumption of guilt, and a media bias against you if your company, or anyone associated with you is being investigated. Now some would say that the government wouldn’t bother investigating anyone if there wasn’t some hanky-panky going on, and they might cite that old quote; “where there is smoke, there’s fire.”

Whereas I see that point, and I am perfectly inclined to place probability bets with Occam’s razor, unfortunately I know too much about the primate politics of power. Okay so let’s talk shall we?

The reality is that if you want your competitor investigated, or someone who is running against you for a particular political office, you can always call in favors from other politicians, the very politicians that hold the purse strings over these agencies who can make a few phone calls of their own to get a regulatory agency to open up an investigation. Once they open up the investigation, it’s like a witch hunt, and even if they don’t find what they’re looking for, they may find something else.

You might say; “well then, they were doing something wrong,” but that’s not the point, that’s not how justice is supposed to work in the United States. Further, it’s far too easy to forget to fill out a form, or to put in the wrong information because you didn’t understand the form. It’s easy to get bad advice from an attorney, a tax accountant, a consultant, or an advisor. Many of the laws and regulations we have are so complex and complicated that it’s almost impossible to follow each one of them as per the letter of the law, not to mention all the follow-up case law which is constantly evolving.

There was an interesting piece in our local six-minute read daily newspaper; The Desert Sun on September 3, 2012 titled; “Bain Among Firms Being Investigated,” which stated that; New York’s attorney general is investigating tax strategies of some of the nation’s largest private equity firms, including Bain Capital, founded by Republican presidential candidate Mitt Romney. Interestingly enough, the issue supposedly at odds with regulators is so common place, it’s hard to say what they are really up to, but I think we all know don’t we?

Okay so, the New York’s Attorney General just happens to be investigating the company which was founded by someone running for president, how convenient? It’s politics as usual, and this sort of nonsense has to stop because if we don’t stop this, we will have nothing more than crony capitalism run by socialists who will protect their own at any cost. That is pure corruption, that is disgusting, and that is not what we are supposed to stand for in this great nation of ours. I’m pissed about this and – this needs to stop. Please consider all this and think on it.…

Foreclosure Q and A – The Moody’s Blues

Foreclosure Q and A – The Moody’s Blues

Before a focus group of Homeowners in foreclosure the topic was: What role did credit ratings agencies play?

Q- Good morning. Let’s get right to it. If I had a train load of junk, toxic waste and used diapers…would you buy this train load or parts of an investment?

A- what does that have to do with my foreclosure?

Q- According to The Louisiana Municipal Police Employees Retirement System, U.S. House investigators, Connecticut Attorney General Richard Blumenthal, the Financial Times and California Atty. Gen. Jerry one did just a train load of kryptonite to superman. Do any of like superman?

A- I feel like a train did run over me.

Q- In the financial train load of kryptonite was sold as if it were bars of gold. You would invest in gold you thought the price had a realistic chance to increase over time and give you a steady income…right?

A- Gold is expensive…I never had that kind of money.

Q- Pension systems did have that kind of money. And they invested these pensions represented your pension would happen to your pension?

A- Golly, I don’t what’s this got to do with my foreclosure situation?

Q- Let’s connect the dots. Your pension dumps trillions into the investment market, based on triple A ratings into ‘solid’ investments. Those dollars are used to fund new mortgages. But it’s more money than the real estate market has a demand for. In other words…there really aren’t that many qualified buyers in the marketplace to soak up all that money. Are you with me?

A- No.

Q- Let’s try it another way. You all drive cars…correct?

A- .

Q- How many times in 5 years do you buy a new car?

A- My car is 9 years old.

Q- Exactly. You don’t have a need to buy a new car every 5 you?

A- No.

Q- What if a new car you Joe…”your grandson will be 16 in 3 years. You’ll have this car paid off in 3 about the time your grand son turns that’s when the insurance starts…because between now and park the car in your garage. you buy this car nothing down, at this really low, low monthly payment of $50 dollars a month and here’s the great are guaranteed to qualify…because I won’t ask much you make…could you pass a deal like this?

A- Not if you put it that way.

Q- Now if I was moving cars that could I continue to get funding for such picturesque loans?

A- Beats me.

Q- Well, suppose my dealership was being bankrolled by Big Money Guys on Wall Street. And Big Money Guys was selling kryptonite to pension funds. And the Ratings agencies were telling pension kryptonite was rated…triple A. Do you think the pension funds would pour money into Big Money Guys?

A- You Money Guys was lying to the rating agencies?

Q- No. I rating agencies seem to know they had just didn’t care.

A- ‘s how I got stuck with this McMansion with an ARM that’s about to reset and take by arm, leg and bowels with it?

Q- Did it really happen that way at your closing?

A- No…I thought I was getting a 30 year at the kids, the Mrs. and my friends all waiting for the good news…I signed the papers…because the lender told me…”don’t can always refi…’because the home prices are still going up.”

Q- Weren’t you concerned…about the loan reset?

A- Well, like I said…”the lender assured me…I could ‘refi’ or sell make a killing.”

Q- never really concerned you that the people who put up the money, the pension investors…might get caught with their pants down?

A- Why should they were willing to put up the I could get the not?

Q- That’s why we called this Moody’s Blues…because now everyone has the blues…because of Moody’s. Did you get something out of this meeting?

A- Well, I still got the what am I gonna do about my foreclosure?

Q- In our next ‘ll address that. But before we I ask you thought about whether your pension fund bought into this junk?

A- . You think that’s why my company is talking about abolishing our pension system and going to a 401K?

Q- Let me think on that. If there is no longer any money in your pension ‘re in a unique a an investor. How does it feel to be an ?

A- Between a rock and…a hard place? When is your next session……

Why Is It Important to Build Credit?

Why Is It Important to Build Credit?

There are a few reasons why an individual may end up having low credit: falling behind on their credit card or mortgage payments, or errors being made on their credit reports. Credit disputes can also lead to low or bad credit. If you are in this situation, you can hire a good credit attorney to help you with these disputes and to correct your credit reports.

Building your credit is important for a number of reasons. For instance, if you have low credit, any loan or mortgage applications will likely be denied. This is because you are viewed as being high. Lenders will normally hesitate before giving any loans to a person with bad credit history, and if you get a loan or credit, they may end up charging you high interest rates.

In addition to the high interest rates, your insurance company may require you to pay equally high premiums. Sometimes, low credit is viewed as an indicator of high claims. To protect them, the insurance company will therefore charge you high premiums.

If you don’t build your credit, other areas of your life will also be affected. Bad credit may also hinder your chances of getting an apartment to lease. The fact that your credit is low will give the impression that you may fall behind in paying your rent. In addition, even if you get the apartment, you will be most likely asked to make a one month rent deposit and a further deposit on your utilities.

Due to the difficulties in getting a loan, low credit scores can affect your ability to even get lending to buy essential goods. If they accept to give you the loan, they may opt to charge you very high interest rates.

Low credit or bad credit history will also affect your ability to get a postpaid cell phone contract service. You may have to go for a prepaid service because most phone companies will be hesitant in giving you credit. They may fear that you will not be able to pay for your phone even after a month of service. Starting your own business may also be hard since getting a start-up capital loan will be difficult.

Ensure that you hire a good credit attorney to help you build your credit and get you financial life back on track. It doesn’t matter whether you have low credit due to errors on your report or late payments. Low credit will have an effect on your future, so do not hesitate and get you credit fixed now.…
